| The following overview of the data speed measuring facility should be read in conjunction with the Broadband Connect Guidelines. This facility has been established as an independent 'ruler' against which Broadband Connect providers, their customers and the Department of Communications, Information Technology and the Arts (DCITA) can assess and determine the data speed of individual Broadband Connect services. |

Broadband Connect data speeds The data speed measuring facility will measure both Broadband Connect threshold services and Broadband Connect added value services. In the case of a Broadband Connect threshold service, the required minimum data speeds for this service are 256kbps (download) and 64kbps (upload). Broadband Connect threshold services are required to have an average data download and upload speeds of at least 60 per cent of these peak speeds at least 75 per cent of the time. Added value services will have peak data speeds above Broadband Connect threshold services. Peak and average data speeds for added value services are nominated by the provider. Customers are informed of these when signing for the service. |

Data speed results If a Broadband Connect customer believes the data speed measuring facility has identified a substandard service they should in the first instance approach their provider for remedial action. Customers should bear in mind that some adverse results may be caused by factors outside of their Broadband Connect provider's control and therefore may not constitute a breach of the Broadband Connect provider's Broadband Connect obligations. In the event that the customer believes that the provider has not satisfactorily addressed their complaint, they may consider referring the complaint to the Telecommunications Industry Ombudsman (TIO). For further details see section 4.6.2.2.1 of the Guidelines. Broadband Connect providers are required to include their average data speed test results in their quarterly compliance reports to DCITA. Broadband Connect services are also subject to monthly testing and random audit. Please refer to 4.6.2.2.3 to 4.6.2.2.7 of the Guidelines for further details. |
